1. Agreement to Terms

By accessing or using AnimatedEmojies (animatedemojies.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

AnimatedEmojies provides a platform for browsing, downloading, and purchasing animated emoji assets. We offer:

• Free individual emoji downloads in various formats (WebP, GIF, Lottie JSON)
• A paid bulk download package containing all 1,100+ available emojis
• A public API for searching and browsing emojis
• Featured emoji slots for creators to promote their emojis
• A blog with articles about emojis, design, and related topics
• A public leaderboard showing the most downloaded emojis

3. Emoji Licenses

The animated emojis available on this website are created by various authors and are subject to their respective licenses. Each emoji's license and author information is displayed on its individual page.

It is your responsibility to review and comply with the license terms of each emoji you download and use. Common licenses include:

• CC BY 4.0 — free for commercial use with attribution (e.g., Google Noto Animated Emoji)
• CC BY-NC 4.0 — free for non-commercial use with attribution
• CC0 / Public Domain — no restrictions
• Other licenses as specified per emoji (some creators, such as Meritt Thomas, may have custom or unspecified license terms)

We provide license information in good faith but make no guarantees about its accuracy. When in doubt, contact the original creator.

4. Purchases and Payments

4.1 Pricing

The bulk emoji pack is available for a one-time payment of $10 USD. Prices are subject to change without notice, but changes will not affect completed purchases.

4.2 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

4.3 Delivery

After successful payment, you will receive a download link via email and on the confirmation page. Download links are valid for 24 hours and allow up to 5 download attempts. Once these limits are reached, the link will expire. If you experience technical issues or need a new link, contact us for assistance.

4.4 Refund Policy

Due to the digital nature of the product, we generally do not offer refunds after the download link has been accessed. However, if you experience technical issues that prevent you from downloading the product, we will:

• Provide a new download link with a fresh 24-hour window and 5 attempts
• Send the files via alternative means (e.g., Google Drive)
• Issue a full refund if we are unable to deliver the product

If you have not accessed the download link, you may request a full refund within 14 days of purchase. To request assistance or a refund, contact us at support@animatedemojies.com within 14 days of purchase. Please include your purchase email address and transaction ID.

4.5 VAT / Tax

Prices are displayed excluding VAT. As a Kleinunternehmer under §19 UStG (German small business regulation), no VAT (Umsatzsteuer) is charged on purchases.

5. Featured Emoji Slots

Creators can book featured emoji slots to promote their emojis on the homepage. The following terms apply:

• Duration — each featured slot lasts for 7 consecutive days from the start date
• Booking deadline — slots must be booked at least 3 days in advance of the desired start date
• Admin approval — all featured slot bookings are subject to review and approval by our admin team; we reserve the right to reject any booking at our sole discretion
• Content requirements — featured emojis must comply with our acceptable use policy and must not contain offensive, misleading, or infringing content
• No guaranteed placement — while we make reasonable efforts to display featured emojis prominently, we do not guarantee specific placement, traffic, or engagement metrics
• Cancellation — if you wish to cancel a featured slot booking, contact us at least 48 hours before the start date for a full refund; cancellations within 48 hours of the start date are non-refundable

6. Blog Content

Our blog provides articles about emojis, design, and related topics. The following terms apply to blog content:

• All blog content is owned by AnimatedEmojies unless otherwise credited
• You may share links to blog posts, but you may not reproduce, republish, or redistribute the full text of blog articles without our written permission
• Blog content is provided for informational purposes only and does not constitute professional advice
• We reserve the right to edit, update, or remove blog posts at any time

7. Acceptable Use

You agree not to:

• Use automated tools to mass-download emojis in a way that overloads our servers
• Redistribute the bulk download package or share your download link with others
• Attempt to bypass payment mechanisms or exploit the download system
• Use the Service for any illegal purpose
• Interfere with or disrupt the Service or its infrastructure
• Misrepresent yourself or impersonate others
• Attempt to access the admin panel or other restricted areas without authorization

8. API Usage

We provide a public API at /api/emojis for programmatic access. By using the API, you agree to:

• Make no more than 60 requests per minute
• Include proper attribution when displaying our data
• Not use the API to create a competing service
• Not use the API to systematically download all emoji assets (use the bulk pack instead)
• Respect the individual emoji licenses
• Not resell or sublicense API access to third parties

We reserve the right to rate-limit, restrict, or block API access at our discretion without notice. The API is provided as-is with no uptime guarantees.

9. Intellectual Property

The AnimatedEmojies website, its design, code, blog content, and branding are owned by us. The emoji assets are owned by their respective creators and are subject to their individual licenses.

The $10 bulk download fee covers the convenience of packaging, hosting, and delivery. It does not transfer ownership of the emoji designs. Individual emojis remain available for free download from this website and from their original sources.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• All emoji files will be free from defects
• The license information provided is complete or accurate
• The Service will meet your specific requirements
• Featured emoji slots will generate any specific level of traffic or engagement
• Blog content is accurate, complete, or up-to-date

11. Limitation of Liability

To the maximum extent permitted by law, AnimatedEmojies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.

If you are a consumer residing in the EU, you also enjoy the protection of any mandatory provisions of the law of your country of residence. You may also bring proceedings in the courts of the country in which you are domiciled.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
